An Uncontested Divorce is a divorce where both parties agree they wish to be divorced and they agree upon the Division of all Marital Property (all property), allocation of all Marital Debts (all debts- who pays what), and how much, if any, alimony.

We have a form for you to fill out to account for all these assets (bank accounts, financial holding, cars, personal property, real property, etc.). All of this information will be put into a Marital Dissolution Agreement (MDA). Both parties must sign this document.

If there are any children of the marriage, then you also have to agree upon the custody and visitation of the children, the tax credits and deductions, and decision making. We also have a form for these issues, as well, which the Court requires. It is called a Parenting Plan. We must also obtain the gross income for both parties, which is used to calculate child support under the Tennessee Child Support Guidelines. If the parties are concerned about child support, we can discuss this at the consultation.

Under Tennessee law, child support must be set according to the number of days each parent has the child, cost of health insurance, and the gross income of the parties. The state provides a spreadsheet into which we insert the numbers and it produces a child support obligation. Parties can decide how many days each year each party will have visitation/custody, which will affect the Tennessee Child Support obligation. If the parties wish to deviate from the Tennessee Child Support guidelines, then they have to have a good reason, and a hearing before the Judge will have to be held to approve or disapprove of such a deviation. This service would require an extra charge.

Powers of Attorney

Our firm can create simple powers of attorney for financial and health care decisions. These are used if a party becomes incapacitated (cannot make decisions for themselves), and they can assign to another individual the power to handle their affairs in the event they become incapacitated.

Basic Wills

Our firm can handle simple wills for individuals or married couples. The rates are low, but vary depending on the circumstances, assets, and the number of beneficiaries. We have a form for you to fill out before we meet to discuss the drafting of your simple will.
